Most Company Arbitration Provisions dictate which party will be responsible for the expenses of the arbitration.  In many cases, the Company will pay all of the expenses, except for those incurred solely by the Claimant.  Some provisions require the Claimant to pay a portion of the Administrative Fee or other expenses.

When a case is initiated with JWA, the responsible party or parties will be billed for a $1,500.00 non-refundable Administrative fee and a refundable Evergreen Retainer of $3,500.00. Disbursements are made to the Arbitrators on a quarterly basis from that fund, which must be replenished as needed.  The Administrative fee and the Evergreen Retainer are the same amount for every case, regardless of the amount in controversy.  Additionally, each of our Judges is paid at the same hourly rate of $450 per hour.

 

Arbitration Provisions typically also address which party is to pay for other expenses like a court reporter for the final Arbitration hearing and the fees for the Arbitrator’s time and expenses.  The Anticipated Arbitration Fees will be due no later than 45 days prior to the first scheduling of the final Arbitration Hearing.
