How Do I Start an Arbitration?
If you’re looking to start an Arbitration with JWA, we’ve got you covered.
The first thing to do is check the Employer’s Arbitration Agreement / Arbitration Provision to see whether it dictates where the case is to be filed. If the document indicates that cases are to be filed with JWA, then it’s easy to get started.
Below is a list of the documents we’ll need to set up your case:
1. Arbitration Cover Sheet – This can be found on our website or by clicking here, and needs to be filled in completely.
2. Pleadings – Either party may initiate Arbitration by submitting a Cover Sheet and their respective pleadings to JWA. Typically, the Claimant should file its Original Complaint in Arbitration with JWA in the same format as a Plaintiff’s Original Petition and forward a copy to the Respondent. For a personal injury case filed against a non-subscriber wherein there exists an Arbitration Provision dictating the forum, JWA requires a copy of the live pleadings and the Order of Abatement from the Trial Court.
3. Arbitration Agreement / Arbitration Provision – It is important to include this document, because a majority of non-subscriber arbitration agreements dictate which party will be responsible for the expenses of the arbitration, as well as details such as the location of the final hearing, etc. Some of the Arbitration Agreements / Arbitration Provisions are older versions and might indicate that documents must be produced to JWA in triplicate via regular mail. That is no longer our policy. You may submit a single copy via email, fax, or regular mail, whichever works best for you.
4. Any Other Pertinent Documents – You may also submit any other documents you wish to include at this time, or you may hold them until the Arbitrator is selected.
Once JWA has received the documents listed above, we will bill the responsible party or parties for the Administrative and Evergreen Retainer Fees. Upon receipt of payment, JWA will send an initial panel of five potential Arbitrators to the parties to begin the selection process, and the case will be in motion.
