Judge Frank Andrews founded Judicial Workplace Arbitrations in 2003. I have had the privilege of being on JWA’s panel of judges since its inception, having been offered the opportunity by Judge Andrews to become a panelist. I have been an active civil litigator for nearly 35 years and most of those years were limited to jury trials throughout the state of Texas as well as other states. In recent years more and more cases (commercial and personal injury) are subject to Arbitration Agreements. Those agreements designate the Arbitration association that will administer the case. My practice involves many arbitration proceedings with many arbitration associations. My experience with JWA for many years has always been one of the most positive. JWA is very easy to work with administratively and JWA does not put concerns over arbitration fees above the content and status of the case. If you need some time to try to resolve the matter before incurring significant fees, you simply have to ask. That is unusual for arbitration associations in my experience. The JWA panels consist of former Judges from throughout Texas and from different political persuasions. This makes many of them more qualified than some other panels and allows the parties to do some research as to their experiences and qualifications before the final arbitrator is selected. Often times, my opposing counsel and I are able to simply pick one of the Judges and agree to the assignment without even going through the strike process. Whether arbitration is better or worse than a jury trial is a debate that can go on forever, but when in arbitration JWA is a very good organization to work with in my opinion.

In representing Texas employers who elect not to opt-in to the state workers’ compensation system, we have had the opportunity to arbitrate matters administered by all the administrative entities.  We have participated in cases administered by Judicial Workplace Arbitrations (“JWA”) from the time Judge Andrews oversaw the JWA to the present.  During that time (almost 20 years), our experience with the JWA case administrators has always been positive.  When requesting information from the JWA, the case administrators have demonstrated they are up-to-date on the status of each case and are able to provide timely responses to our questions.  Further, the case administrators are consistently friendly and helpful.  It is not unusual for a JWA case administrator to provide the parties with a ‘friendly reminder’ of an upcoming hearing or deadline, and in doing so have saved this party from the consequences of a missed deadline.
